Payment Terms and Conditions
 Spring Finance Limited  (“we”, “our” or “us”) is a company registered in England and Wales under company number 3709012 and with our registered office address at 3 Theobald Court, Theobald Street, Borehamwood WD6 4RN.

Please read these online payment terms carefully before using the online payment facility. Using the online payment facility on this Site indicates that you accept these terms. If you do not accept these terms do not use the online payment facility.

We reserve the right to amend these online payment terms at any time without notification. Up to date online payment terms will be available on the Site and any amended terms will be effective immediately on being posted to the Site.  It is your responsibility to ensure you are aware of any amendments to these online payment terms.

Definitions & interpretation
The terms used in this agreement have the meanings set out below unless the context requires otherwise:

  • “Card Issuer” means the institution (which may be your bank) which issued the debit card you are using to make payment via the Online Payment Facility.
  • “Online Payment Facility” means the internet based payment system operated by the Service Provider on our behalf.
  • “Loan Account” means the account operated and maintained by us to record the borrowings and outstanding debt owed to us by you.
  • “Service Provider” means the third party service provider operating the Online Payment Facility on our behalf.
  • “you” or “your” means the individual holding the Loan Account and making up a payment via the Online Payment Facility.

Payments
Online payments can be made using the cards specified below and must be in GBP i.e. UK Pound Sterling.

Acceptable card types:

  • Visa Debit Card
  • Mastercard Debit
  • Visa Credit Card
  • Mastercard Credit Card

 

No charge will be made by us for online payments, if made via debit card. We reserve the right to charge a processing fee if payment is made via a credit card.

If you are an existing borrower, we are unable to accept payment via credit card online. If you wish to pay using a credit card, you must contact the customer services team on 020 3910 8700
 

If your payment is overdue and recovery action is about to be taken, you should contact us.

We have no liability for a payment not reaching the correct Loan Account due to you quoting an incorrect Loan Account number or incorrect personal details.

We have no liability where payment is refused or declined by the Card Issuer for any reason, and we are under no obligation to bring this fact to your attention. You should check with your Card Issuer that payment has been deducted from your account.

Service Provider
These payments are not process by us directly, but by the Service Provider. When using our online payment system you will be redirected to the Service Provider who will process your payment card details and payment. Payment card details are handled exclusively by the Service Provider and are not stored within our system.

During the payment process you will be required to enter the debit card security code and you may be asked for further card authentication by your Card Issuer.

 Confirmation of payment
You will receive a confirmation of your payment on your screen after you make the payment. You can print this out as confirmation by selecting your normal method of printing information shown on your screen. In the event that your payment is refused or declined you should contact your Card Issuer.  If your payment was accepted but you do not receive confirmation or there is some other issue in relation to your online payment (other than it being refused or declined) it is your responsibility to contact us (not the Service Provider) to query why payment has not been accepted.

Refund Policy
Refunds for overpayments can only be made in accordance with the loan agreement and/or our refunds policy. Refunds (if applicable) will only be made to the debit card used for the original transaction.

Security
We shall not be liable for any failure by you to properly protect data from being seen on your screen by other persons or otherwise obtained by such persons, during the online payment process or in respect of any omission to provide accurate information in the course of the online payment process.

We do not collect or store any card details. The payment process is completed on the Service Provider’s secure website.

Data Protection & Privacy Statement
We shall abide by the principles of the Data Protection Act 1998 and ensure that the data is used for no other purposes and is disclosed to no third party.

Disclaimer of Liability
We have no liability for any damages (including, without limitation, those resulting from lost profits, lost data or business interruption) whatsoever and howsoever caused arising out of the use, inability to use, or the results of use of the Online Payment Facility, this Site, any websites linked to this Site, or the materials or information contained at any or all such websites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.

Applicable Laws
This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) is governed by and interpreted in accordance with English law. The parties agree to submit to the exclusive jurisdiction of the English Courts in relation to any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes or claims).
